Terms of Use

1. Who we are

"Foodify", "we", "us" or "our" refers to the operator of the Foodify Service, an AI-assisted nutrition tracking and meal-planning iOS application. References to "you" or "your" mean the individual who has installed the app and/or holds a Foodify account.

2. Eligibility and accounts

2.1 Age requirement

You must be at least 16 years of age (or the minimum age of digital consent in your country, whichever is higher) to create a Foodify account and use the Service. If you are below this age, you must not use Foodify. We do not knowingly collect personal information from children under the applicable digital-consent age; see our Privacy Policy — Children's Privacy.

2.2 Account creation

Foodify accounts are created through Sign in with Apple or Sign in with Google. You are responsible for:

• maintaining the security and confidentiality of the identity provider account used to sign in;
• all activity that occurs under your account, whether or not authorized by you;
• providing accurate biometric and lifestyle information used to compute your nutrition targets.

2.3 Account suspension

We may suspend or terminate your account if we reasonably believe you have violated these Terms, abused the Service (including AI rate limits or App Check protections), or used Foodify for unlawful purposes.

3. License to use Foodify

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the Foodify app on an iOS device that you own or control, solely for your personal, non-commercial use.

You may not: (a) resell, rent, lease, or sublicense Foodify; (b) reverse engineer, decompile, or disassemble the app except where permitted by law; (c) remove or alter any proprietary notices; (d) use the Service to build a competing product or service.

4. Acceptable use

You agree not to use the Service to:

• upload, scan, or transmit content that is unlawful, fraudulent, defamatory, obscene, or infringing on third-party rights;
• impersonate any person, falsify ownership of an account, or misrepresent your affiliation with a person or entity;
• attempt to bypass authentication, rate-limiting, Apple App Check / AppAttest, or any security measure protecting the Service;
• probe, scan, or test the vulnerability of any Foodify system, except as part of a coordinated disclosure agreed with us in writing;
• use automated scripts, bots, or scrapers against the Foodify backend;
• use the Service in ways that could endanger your health (e.g., overriding minimum calorie warnings, ignoring allergy disclosures, or instructing the AI to produce dangerous fasting plans).

We may, at our discretion, remove content, suspend access, or report illegal activity to relevant authorities.

5. AI features and content

5.1 What our AI does

Foodify includes several AI-powered features, including: (i) on-device food image classification (Core ML), (ii) cloud-based multi-food image analysis, (iii) personalized daily and weekly nutrition summaries, (iv) personalized meal-plan generation, and (v) the Foodify Chat AI dietitian assistant. These features are powered by large-language and vision models served via our secure backend proxy.

5.2 AI consent

Cloud-based AI features are integral to Foodify. By accepting these Terms and using the app, you consent to the AI processing of your data described in our Privacy Policy (Section 5). Single-food photo recognition runs on-device and does not use cloud AI. The optional Allow Model Image Sharing setting is separate, is off by default, and can be toggled at any time. If you do not wish to have your data processed by our AI, do not use the cloud AI features; you may also delete your account at any time.

5.3 Accuracy and limitations

AI outputs — including detected food names, estimated portions, calories, macros, recipes, plan-alignment verdicts and chat replies — are estimates generated by probabilistic models. They may be inaccurate, incomplete, or out of date. You should not rely on AI outputs for any decision that materially affects your health or safety without independent verification.

5.4 Scope of Foodify Chat

Foodify Chat is scoped strictly to nutrition, hydration, fitness habits, and related lifestyle topics. The assistant will refuse to discuss medical diagnosis, prescription, politics, finance, legal matters, or other off-scope subjects. We do not guarantee any specific response.

5.5 You remain responsible

You are responsible for what you eat, drink, and do based on Foodify outputs. If you have allergies, intolerances, or medical conditions, you must verify every meal independently regardless of what the app suggests.

6. Not medical advice

Foodify is not a medical device. The Service is provided for general health and lifestyle information purposes only. Nothing in the app, including AI-generated meal plans, weekly reports, body composition estimates (BMI, body fat %, FFMI, WHR), or chat responses, constitutes medical advice, diagnosis, or treatment.

Always seek the advice of a qualified physician or other healthcare professional with any questions regarding a medical condition, nutritional needs, eating disorders, pregnancy, lactation, allergies, or any health concerns. Never disregard professional medical advice or delay seeking it because of something you read or saw in Foodify.

If you experience symptoms suggesting a disordered eating pattern, please contact a healthcare professional or a relevant support organization in your country immediately.

7. Apple Health and HealthKit

Foodify can read activity data from Apple HealthKit, including step count, active energy burned, and basal energy burned, in order to refine your daily calorie targets and net-calorie display.

• HealthKit access is read-only and only enabled if you explicitly grant permission through iOS.
• You may revoke HealthKit permission at any time via the iOS Settings → Privacy & Security → Health menu.
• We do not share, sell, or transmit HealthKit data to any third party for advertising or analytics purposes. HealthKit data is used solely to power your in-app experience.
• We comply with all applicable Apple HealthKit data-use restrictions.

8. User content and license to us

"User Content" means the data you create or upload through the Service, including food photos, custom food entries, weight and body-measurement entries, questionnaire answers, chat messages, and any other content tied to your account.

8.1 Ownership

You retain ownership of your User Content. We do not claim ownership of your photos or entries.

8.2 License you grant us

You grant Foodify a limited, worldwide, non-exclusive, royalty-free license to host, store, transmit, process, analyze, display, and otherwise use your User Content solely as necessary to provide and improve the Service to you — including running AI analysis on the images and text you submit, generating your meal plan, and showing your history. This license terminates when you delete the content or your account, except where retention is required to comply with law.

8.3 Optional model-improvement contribution

If you toggle on the optional image-sharing setting in Foodify, you also grant us a non-exclusive license to use de-identified copies of your food images to improve our food-recognition models. This is off by default and can be revoked at any time. Revocation prevents future sharing; we do not retroactively reclaim copies already used in training.

9. Subscriptions and in-app purchases

Foodify offers an optional auto-renewing subscription, Foodify Pro, that unlocks the app's full set of features. A set of free features remains available without a subscription.

Pricing. Foodify Pro is offered at US$49.99 per year or US$11.99 per month, and new subscriptions may include a 3-day free trial. Prices vary by country and currency — Apple sets local pricing and adjusts for taxes and exchange rates, so the exact price and trial terms are always shown to you in the app, in your local currency, before you confirm any purchase.

All purchases are processed through the Apple App Store under Apple's standard terms:

• Payment is charged to your Apple ID when you confirm the purchase.
• Subscriptions auto-renew at the then-current price unless cancelled at least 24 hours before the end of the current period.
• If a free trial is offered, it automatically converts to a paid subscription unless cancelled at least 24 hours before the trial ends; any unused portion of a trial is forfeited once you buy a subscription.
• You can manage or cancel any time in your Apple ID's Settings → [your name] → Subscriptions. We cannot cancel an Apple-billed subscription on your behalf.
• Refunds, where available, are issued by Apple at their discretion, in line with Apple's policies.

We may change Foodify Pro's price or features from time to time; any change applies only to future billing periods, and we will give clear notice where required by law.

10. Third-party services

Foodify integrates the following third-party services. Each service is governed by its own terms and privacy policy:

• Google Firebase (Authentication, Firestore, Storage, App Check, Cloud Functions, Analytics, FCM) — backend infrastructure.
• Apple Sign in with Apple & Google Sign-In — identity providers.
• Apple HealthKit — read-only activity data.
• Google Gemini API (via our backend proxy) — AI analysis, summaries, chat, multi-food vision.
• USDA FoodData Central — public nutrition database lookups.
• Open Food Facts — barcode-based product information.

We are not responsible for the practices or content of these third parties. Their availability is not guaranteed and may change without notice.

11. Intellectual property

All intellectual property rights in the Foodify app, including its source code, machine-learning models, the Foodify name, the Foodify wordmark, the mascot illustration, app icons, interface designs, screenshots, marketing copy and audio, are owned by Foodify or its licensors. Nothing in these Terms transfers any such rights to you.

You may not use the Foodify name or marks for commercial purposes, sponsorships, or anything that suggests endorsement, without prior written permission.

12. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM HARMFUL COMPONENTS.

WITHOUT LIMITING THE ABOVE, WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF:

• FOOD IDENTIFICATION OR PORTION-SIZE ESTIMATES;
• CALORIE OR MACRO-NUTRIENT VALUES PULLED FROM PUBLIC DATABASES;
• BMI, BODY FAT %, FFMI, WHR OR OTHER BODY-COMPOSITION ESTIMATES;
• AI-GENERATED MEAL PLANS, DAILY SUMMARIES, WEEKLY REPORTS, OR CHAT REPLIES.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL FOODIFY, ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, LOSS OF DATA, BUSINESS INTERRUPTION, OR HEALTH-RELATED CONSEQUENCES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF — OR INABILITY TO USE — THE SERVICE.

OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

14. Indemnification

You agree to indemnify and hold harmless Foodify, its affiliates and personnel from any claim, demand, loss, liability, or expense (including reasonable legal fees) arising out of: (a) your violation of these Terms; (b) your User Content; (c) your misuse of AI features or HealthKit data; or (d) your infringement of any third-party rights.

15. Termination

You may terminate your account at any time from within the app (Profile → Delete account). On termination:

• Your Firestore documents (profile, foods, water, weights, body measurements, achievements, meal-plan history, questionnaire, chat) are recursively deleted.
• Your Firebase Storage images (food photos and multi-food photos) are deleted.
• Your refresh tokens are revoked and your Firebase Auth user is deleted.
• Where applicable, your Apple Sign-In token is revoked.

We may terminate or suspend access immediately, without prior notice, if you breach these Terms or if continued provision of the Service is prohibited by law. Sections 11–14 and 17 survive termination.

16. Changes to the Service or Terms

We may update, modify, or discontinue any part of the Service at any time without notice. We may revise these Terms from time to time. When we make material changes, we will notify you in-app or by updating the "Effective" date above. Continued use of the Service after a change constitutes acceptance of the revised Terms.

17. Governing law & disputes

These Terms and any dispute arising out of or related to them or the Service shall be governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply.

To the extent permitted by law, any dispute shall be resolved in the courts of Istanbul, Türkiye. If you are an EU/UK consumer, you may also bring claims in the courts of your country of residence.

18. Apple App Store terms

If you downloaded Foodify from the Apple App Store, the following additional terms apply:

• These Terms are between you and Foodify, not Apple. Apple has no obligation whatsoever to furnish maintenance or support for the app.
• Apple is not responsible for any product warranties, whether express or implied by law. In the event of any failure of the app to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any).
• You and Foodify acknowledge that Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
• You must comply with all applicable third-party terms when using the app, including the App Store Terms of Service.
